By downloading, installing, or using KidneyKind™ (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App.

Who We Are

KidneyKind™ is developed and operated by KindSoft LLC ("KindSoft," "we," "us," or "KidneyKind"), a Florida limited liability company. The App is distributed through the Apple App Store and runs on iOS, iPadOS, and watchOS.

Not Medical Advice

KidneyKind is a personal tracking tool to help you keep an organized record of your dialysis sessions, vitals, labs, medications, fluid intake, symptoms, appointments, and transplant journey. It is not a medical device.

The information shown in the App — including reference ranges for lab values, suggested fluid limits, kidney-friendly recipes, educational guides, and any analysis of the data you log — is for general informational purposes only. It is not medical advice, diagnosis, or treatment.

Always consult your nephrologist, dietitian, dialysis nurse, transplant team, or other licensed healthcare provider for any decisions about your care. Never disregard professional medical advice or delay seeking it because of something you read or saw in the App. If you think you may be having a medical emergency, call your emergency services number immediately.

You must acknowledge this disclaimer on first launch of the App before you can use its features. You can re-read the full disclaimer at any time in Settings → Legal → Disclaimer & Terms within the App.

Subscription & Free Trial

KidneyKind is offered as an auto-renewing subscription with a 14-day free trial for new users. After the trial ends, your chosen subscription plan begins automatically unless you cancel before the trial ends.

Four subscription tiers are available, all within a single subscription group so you can move between them without being double-charged:

Prices listed above are in US dollars. KidneyKind is available on the App Store in the United States, Canada, United Kingdom, Ireland, Australia, and Japan. Pricing on the Canadian, UK, Irish, Australian, and Japanese App Stores is set by Apple's regional price-tier conversion, and you will see the local-currency price on the App Store before purchase. Apple handles all payment processing — KidneyKind never sees, stores, or has access to your payment information.

Auto-Renewal

Payment will be charged to your Apple Account at confirmation of purchase. Your subscription automatically renews for the same period at the then-current price unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time by going to Settings → [Your Name] → Subscriptions on your iOS device, or via the App Store.

No refund is provided for the unused portion of the current subscription period after cancellation, except where required by law.

What Happens if Your Subscription Lapses

If your subscription expires — whether because your trial ended without renewal, you canceled, or a billing attempt failed — you retain read-only access to all data you have previously entered. You will continue to be able to:

While your subscription is lapsed, you will not be able to log new sessions, new vitals, new labs, new medications or doses, new appointments, new care team contacts, or update your transplant journey. Apple Health auto-sync, the kidney health news feed, and kidney-friendly recipes are also paused until you renew. A non-intrusive banner on affected screens will remind you how to resume.

This design is deliberate: locking a dialysis patient out of their own care team contacts or treatment history due to a billing issue is unacceptable.

Restoring Purchases

If you reinstall the App, install it on a new device, or use Family Sharing (where available), you can restore your active subscription via the Restore Purchases button inside the paywall or at Settings → Membership.

Your Responsibilities

You are responsible for the accuracy of the data you enter into the App. The App's outputs (trend charts, reference-range flags, PDFs, exports) reflect what you have entered and cannot verify its correctness. You are also responsible for maintaining the security of your Apple Account, since your App data may be synced to your private iCloud.

You must be at least 13 years old to use the App, and if you are between 13 and the age of majority in your jurisdiction, a parent or legal guardian must agree to these Terms on your behalf.

Intellectual Property

KidneyKind™ is a trademark of Michael McGarry, filed with the U.S. Patent and Trademark Office (serial 99761418, intent-to-use). The App, its source code, artwork, copy, and user interface are the property of KidneyKind, protected by U.S. and international copyright and trademark law.

Kidney-friendly recipes displayed in the App are sourced from public web content made available by DaVita, Kidney Kitchen, and other public recipe providers. KidneyKind is not affiliated with these organizations. Users who enable optional Spoonacular integration provide their own Spoonacular API key — KidneyKind is not responsible for Spoonacular's content or terms.

Third-Party Services

The App integrates with several Apple system services under your control: iCloud (CloudKit), HealthKit, Calendar, Contacts, Notifications, and the App Store. It also fetches public RSS feeds from kidney-health news sources and recipe content from the providers listed above. None of these integrations transmit your personal or health data to KidneyKind's developer.

Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or that any defects will be corrected.

Limitation of Liability

To the maximum extent permitted by law, KidneyKind shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any medical or treatment decisions made based on information displayed in the App; (c) any unauthorized access to your data via Apple's services; or (d) any other matter related to the App.

Nothing in these Terms limits liability that cannot be limited under applicable law.

Changes to These Terms

We may update these Terms from time to time. Material changes will be noted at the top of this page with a revised "Last updated" date, and called out in the App Store release notes for the corresponding App version. Continued use of the App after a change constitutes your acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the United States and the state in which KidneyKind is established, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the App shall be resolved in the courts of that jurisdiction.
